Keith Lucy, who lost his re-election bid to the Board of Selectmen last week, will be arguing his case to a trial jury.
Former Selectman Keith Lucy will be heading to trial next month in Salem District Court to argue against an assault charge being brought by the Essex County District Attorney's office. The Salem News reports that Lucy and his attorney Michael Smerczynski (who is also the City Solicitor for Peabody, for the record) have decided to not seek dismissal of the charge after all, but rather argue the case at trial. The trial is set for June 26. Lucy, who lost his re-election bid to the Board of Selectmen last week, pleaded not guilty at his initial arraignment in November and denies the allegation. The DA's office took over the case for the alleged victim, John Fratus, after probable cause was found earlier this year. Fratus sought the charge …

When voters hit the polls May 7 for the Town Election, they'll have to decide contested races on the Board of Selectmen and the Housing Authority. Selectmen Keith Lucy and Dan Bennett are both up for re-election and face a challenge for one of their seats from retired judge David Mills. Mills, reports the Salem News, is a former prosecutor and Danvers Town Moderator and spent 25 years as a Town Meeting member. He was first appointed as a judge in 2001. Lucy, an electrical engineer, is finishing up his third three-year term on the board and is currently second in seniority to Selectman Michael Powers. The attorney representing a Danvers Selectman facing an assault charge says his next move will be to ask a judge to dismiss the charges. Keith Lucy, a member of the Danvers Board of Selectmen, is facing a charge of assault after an alleged altercation in Danvers Town Hall on primary election night on Sept. 6. The alleged victim, John Fratus of Appleton Street, sought the charge himself and it was not handled by police. He went to court and after a magistrate's hearing it was found there was probable cause to go forward. A member of the Danvers Board of Selectmen is scheduled to be arraigned Tuesday on assault charges in connection with an incident at Town Hall on Election Day in September. Keith G. Lucy, 47, of 7 Ashley Lane faces a single count of assault after the incident on Sept. 6, the day of the primary election. The charges were not filed by police but instead by a citizen, who sought a hearing in front of a Salem District Court magistrate. That magistrate, who heard the complaint from Town Meeting member John Fratus of Appleton Street in a hearing closed to the public, found there was probable cause to issue a criminal complaint against Lucy.
